1) Scope
1.1 These Terms and Conditions (hereinafter "T&C") of Camolee (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or business (hereinafter "Customer") enters into with the Seller regarding goods displayed by the Seller in their online shop. The inclusion of the Customer’s own conditions is expressly rejected unless otherwise agreed.
1.2 These T&C also apply to contracts regarding the provision of digital content, unless otherwise specified. Digital content within the meaning of these T&C refers to data that is created and made available in digital form.
1.3 For the purposes of these T&C, a consumer is any natural person who enters into a legal transaction for purposes that are primarily outside their trade, business, or profession.
1.4 A business is a natural or legal person, or a legally capable partnership, acting in the exercise of their trade, business, or profession when entering into a legal transaction.
2) Contract Conclusion
2.1 The product descriptions on the Seller's online shop do not constitute binding offers by the Seller but are used for the Customer to submit a binding offer.
2.2 The Customer can submit the offer via the online order form integrated into the Seller’s online shop. After the Customer has placed the selected goods in the shopping cart and completed the electronic order process, clicking the button that completes the order process constitutes a binding offer to purchase the goods in the shopping cart.
2.3 The Seller may accept the Customer's offer within five days:
- By sending a written order confirmation or an order confirmation in text form (fax or email) to the Customer, where the receipt of the order confirmation by the Customer is decisive, or
- By delivering the ordered goods to the Customer, where receipt of the goods by the Customer is decisive, or
- By requesting payment from the Customer after the order has been placed.
The contract is concluded when one of these alternatives occurs first. The acceptance period starts on the day after the Customer sends the offer and ends on the fifth day after sending the offer. If the Seller does not accept the Customer's offer within the specified period, the offer is deemed rejected, and the Customer is no longer bound by their offer.
2.4 If PayPal is selected as the payment method, the payment processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"). Payments are subject to PayPal's Terms of Use, available at PayPal's website.
3) Right of Withdrawal
3.1 Consumers have a right of withdrawal.
3.2 Detailed information regarding the right of withdrawal can be found in the Seller’s withdrawal instructions.
3.3 The right of withdrawal does not apply to consumers whose sole residence and delivery address are outside the United States at the time of the contract formation.
4) Prices and Payment Terms
4.1 Unless otherwise stated, the prices listed by the Seller include applicable taxes. Additional shipping costs, if any, will be indicated in the product description.
4.2 For deliveries to countries outside the United States, additional costs may apply, including those for bank transfers (e.g., transfer fees, exchange rate fees) or import duties and taxes (e.g., customs duties). These costs are the Customer's responsibility.
4.3 Payment options available to the Customer will be communicated in the Seller's online shop.
4.4 If the payment method "PayPal" is selected, payments are processed through PayPal, which may also involve third-party payment service providers. If the Seller offers payment methods like invoicing or installment payments, these payments may be transferred to PayPal or another third-party provider.
5) Shipping and Delivery Terms
5.1 If the Seller offers shipping, the delivery will be made to the Customer’s specified delivery address, within the specified delivery area.
5.2 If delivery fails due to reasons attributable to the Customer, the Customer will bear the reasonable costs incurred by the Seller.
5.3 If the Customer is a business, the risk of loss or damage to the goods passes to the Customer once the Seller hands the goods over to the carrier. If the Customer is a consumer, the risk generally passes upon delivery.
6) Grant of Usage Rights for Digital Content
6.1 Unless otherwise specified, the Seller grants the Customer a non-exclusive, unlimited right to use the provided digital content for private and commercial purposes.
6.2 The transfer of the digital content to third parties or making copies for third parties outside the terms of these T&C is not permitted unless the Seller consents to such a transfer.
7) Retention of Title
The Seller retains ownership of the delivered goods until full payment has been received.
8) Warranty (Defects)
8.1 Unless otherwise stated, the statutory warranty provisions apply.
8.2 If the Customer is a business, the warranty period for new goods is one year from delivery. For used goods, warranty claims are excluded.
